When someone has a mental health issue, town teams and ICBs must give free care help to anyone who was held under Section 3 of the Mental Health Act, a news group reported.
A report set for a council group on 8 July says, "Some people with a learning issue or autism use mental health help. They should get the same help as others using these services, but Mr. Y did not get this same help."
It notes that it's "key" to find the right care person to guide one through the tough care setups and keep things steady.
The ombudsman saw that the local rules were tight, saying that a caregiver had to be from healthcare, while the big rules allowed social workers to do it too.
The ombudsman also saw a mix-up in how tasks were shared between the ICB and CPFT.
"The range covers those with mental illness and tough behavior, which then leaves a hole as there are no set care roles for special learning disability health help," the report says.
Peterborough City Council's group is set to think about having CPFT, the ICB, and the council find a quick fix before local rules and setup problems are sorted by having Mr. Y's social worker be the care person.
The group will also look at a full check of current rules and plans to match the big rules.
